Introduction

AUTOSERV GLOBAL congratulates you on the purchase of the VEHICLE SERVICE PLAN and we trust that you will enjoy many and safe motoring miles with your vehicle. The SERVICE PLAN is provided and administered by AUTOSERV GLOBAL; we specialize in providing and administering vehicle service plan products. The SERVICE PLAN is designed to allow the CLIENT routine servicing their VEHICLE at an approved R.M.I & Green Drive Workshops at the normal service intervals prescribed in the OWNER’S MANUAL during the
OWNERSHIP of the vehicle.

The SERVICE PLAN covers new and used petrol/diesel passenger vehicles and light commercial vehicles having a gross vehicle mass of less than that 3000kgs. The SERVICE PLAN does not cover vehicles that are or have been used in any form of motor racing or competition. To maintain the validity of the SERVICE PLAN the CLIENT has to comply with the terms and conditions thereof and in particular the servicing requirements.

Undertaking to Service

AUTOSERVGLOBAL agrees to provide the CLIENT, in consideration of payment of the CONTRACT PRICE, with routine servicing of the VEHICLE by an APPROVED DEALER at the normal service intervals prescribed in the OWNER’S MANUAL, for the term and duration of the OWNERSHIP OF THE VEHICLE and subject to the terms, conditions and exclusions as set out in the SERVICE PLAN’S STANDARD TERMS AND CONDITIONS.

Service Standard Terms and Conditions

Herein before and herein after, unless the context indicates otherwise or the contrary, the following words and/or expressions used shall have the meanings assigned to them hereunder: – ‘’AUTOSERV GLOBAL ’’ means AUTOSERV GLOBAL ‘’APPROVED DEALER’’ means the supplying dealer or any authorized dealer or servicing agent Appointed by the IMPORTED or MANUFACTURER as an authorized retail/service
dealer in the TERRITORY: ‘’CLIENT’’ means the party so named in the ENROLLMENT FORM. ‘’CONTRACT PERIOD’’ means the period stated in the ENROLLMENT FORM; ‘’ENROLLMENT FORM’’ means the enrollment form completed and signed by or on behalf of the CLIENT.
‘’IMPORTER’’ means the franchised importer and distributor of the VEHICLE marquee in the TERRITORY. ‘’MANUFACTURER’’ means manufacturer of the VEHICLE. ‘’OWNER’’ means the person who holds all rights, title and interest in and to the VEHICLE or who holds substantially all the risks and rewards incident to the ownership of the vehicle and to whom title may or may not ultimately pass, and the term ownership shall have a corresponding meaning. ‘’OWNERS MANUAL’’ means the user manual originally provided to the OWNER upon the purchase of the VEHICLE when new, which consists of one or more booklets and includes the manufacturer’s standard limited warranty. ‘’SERVICE PLAN’’ means the service agreement between the Client and AUTO SERV GLOBAL SA and set out in the ENROLLMENT FORMS and the SERVICE STANDARD TERMS AND CONDITIONS; ‘’SERVICE STANDARD TERMS AND CONDITIONS’’ means these Service plan standard Terms and Conditions.
“TERRITORY” means the GLOBAL. ‘’VEHICLE’’ means the vehicle specified in the ENROLLMENT FORM. In the interpretation hereof:- Clause headings have been inserted for convenience only and shall not be taken into account; and Words importing the singular include the plural
and vice versa and natural persons include created entities (corporate or no incorporate) and vice versa. The SERVICE PLAN shall also incorporate as express terms and conditions all the contents of the OWNER’S MANUAL, which the CLIENT will be deemed to have read

Commencement

The SERVICE PLAN shall commence upon date of ENROLLMENT of the OWNER / VEHICLE and shall endure for the term and duration of the OWNERSHIP OF THE VEHICLE. The Service and Motor Aid Mechanical failure Plan will only be activated upon full receipt of payment from the Client.

Service Work

The routine servicing of the VEHICLE that AUTOSERV GLOBAL undertakes to provide shall comprise the work set out in general overview below, which work is covered in terms of the SERVICE PLAN and will, following approval by AUTO SERV GLOBAL, be performed by any APPROVED DEALER or appointed service dealer on behalf of AUTOSERV GLOBAL. AUTOSERV GLOBAL reserves the right to nominate a service dealer as required. The SERVICE PLAN covers the following work, subject to the exclusions and limitations. Set forth below: All routine service work specified in the OWNER’S MANUAL to be performed during prescribed periodic inspections and standard service intervals prescribed in the
OWNER’S MANUAL; and Any preventative treatment, checks or other service work, which AUTOSERV GLOBAL in its absolute discretion determines to be necessary to perform. All routine services under or in terms of the SERVICE PLAN shall include the supply of engine oil, transmission oil, brake fluid and other lubricants and service products required to perform any of the work referred to above. The service plan covers the routine service work on the engine and chassis numbers specified on the enrollment forms

Exclusions

The Client acknowledges and agrees that the following is not included in the work covered under the SERVICE PLAN. Any maintenance and mechanical repairs, whether it may become necessary to perform as a result of normal wear and tear deterioration or otherwise;
Repair or replacement of any windscreen, window, lens or damaged glass, window mechanisms, the carpets, trim, seat covers, paint work or body panels., tires, accessory, modification, equipment or any other non-standard item or an item not fitted to the VEHICLE when originally manufactured, electrical wiring, immobilizer security or alarm systems or in-car entertainment systems and speakers (whether manufacturer fitted or not) and the repair of rust corrosion; brake pads, brake discs, shock absorbs, brake linings and skimming of discs or drums; Daily or other regular checks required between routine servicing, including the checking of coolant levels, lubricant levels, tyre pressure, anti-freeze additives as
specified in the OWNER’S MANUAL and obtaining of petrol or diesel fuel, engine oil, transmission oil, brake fluid, and other lubricants and service products or any other preventative maintenance to the VEHICLE.

Cleaning of the VEHICLE and its engine, valet services and provision of additives, oil and lubricants not specified in the OWNER’S MANUAL.
Purchase of the VEHICLE when new, causing sudden stoppage of their functions and necessitating repair or replacement; Work covered by or the cost of which is recoverable under the manufacturer’s standard limited warranty or under any comprehensive motor vehicle insurance or
under any mechanical insurance covering the VEHICLE. Replacement or service of parts components, which are not genuine or components
(manufactured originally by or under license of the manufacturer) or which not repaired to the approval of AUTOSERV GLOBAL
Work required as a result of or caused by or due to: Accidents, collisions, acts of God or any incident caused solely or partly by any
negligent act or omission; The use of oils, lubricants or additives other than those prescribed in the OWNER’S
MANUAL or polluted or impure petrol or diesel fuel, oil or lubricants Neglect, misuse, abuse or improper treatment of the VEHICLE or any of its
components or part; Work performed on the VEHICLE by a person other than an APPROVED DEALER;

Failure to strictly adhere to or observe the terms and conditions of the manufacturer’s standard limited warranty contained in the OWNER’S MANUAL or any AUTOSERV GLOBAL approved service plans covering the VEHICLE or the OWNER’S obligations in terms of the OWNER’S MANUAL or any of the manufacturer’s directions contained in the OWNER’S MANUAL; and Any of the events that may give rise to AUTOSERV GLOBAL right to terminate the SERVICE PLAN in terms of section “Force Majeure’’ below. AUTOSERV GLOBAL liability and obligations under the SERVICE PLAN shall be limited to carrying out the routine service work set forth in section “Service Work” above and shall (without limiting the generality of the foregoing), not include: The recovery or towing of the vehicle or road side assistance or the cost thereof in the event of accident or breakdown; or the provision or the cost of alternative transport, public transport or accommodation in the event of accident or breakdown;
or The provision or the cost of a loan or replacement vehicle. The gradual reduction in operating performance commensurate with age and
kilometre age covered by the VEHICLE is not covered under the SERVICE PLAN.

This includes, but is not limited to, gradual loss of engine compression necessitating the repair of valves or rings and gradual increase in oil consumption due to normal operating functions. AUTOSERV GLOBAL reserves the right to add, from time to time and at any time and at its own discretion further exclusions to the SERVICE STANDARD TERMS AND CONDITIONS by giving 30(thirty) days prior notice thereof to the CLIENT.

Clients Obligations

The CLIENT undertakes and agrees:
To make the VEHICLE available to an APPROVED DEALER by prior appointment during normal working hours of an APPROVED DEALER at or before the relevant service interval specified by the manufacturer in the OWNER’S MANUAL.
The CLIENT must sign the prescribed order for repair before and work covered under the SERVICE PLAN is performed.
After the service has been completed, the CLIENT shall inspect the VEHICLE so as to ensure that such work is satisfactory and complete in all respects.

The CLIENT shall check the APPROVED DEALER’S invoice if presented to ensure that only the service requested was carried out and shall sign the invoice to verify this fact.
AUTOSERV GLOBAL SA shall not be liable for the rectification of any work arising as a result of the CLIENT failing or refusing to follow the aforementioned procedures;

To advise the APPROVED DEALER at which the VEHICLE is being serviced of the need in terms of the SERVICE PLAN to obtain AUTOSERV GLOBAL  prior approval three working days before commencing the service of the VEHICLE;
To comply with the instructions given in the OWNER’S MANUAL in regard to the use, care, service and maintenance of the VEHICLE. The CLIENT must have the VEHICLE regularly serviced by an APPROVED DEALER at or near the service intervals stipulated by the manufacturer in the OWNER’S MANUAL. A maximum allowance of 500(Five Hundred) kilometres either side of the stipulated service intervals or 30(thirty) days either side from the time service intervals stipulated in the OWNER’S MANUAL shall be permitted to take all reasonable steps to maintain the VEHICLE and keep it in a proper and efficient state of repair and in the event of any mechanical and /or electrical failure to use all reasonable means to protect the VEHICLE from, loss or damage;
That it is essential that an accurate record be kept for purposes of the SERVICE PLAN of the distance traveled by the VEHICLE. Accordingly the CLIENT agrees that:-
As and when required by AUTOSERV GLOBAL or APPROVED DEALER acting on behalf of AUTOSERV GLOBAL, the owner will furnish proof of the distance traveled by the VEHICLE.
He will immediately inform AUTOSERV GLOBAL  or an APPROVED DEALER, acting on behalf of AUTOSERV GLOBAL, should the factory-fitted odometer, used for measuring the distance traveled by the VEHICLE fail to operate or suffer any damage in which event the CLIENT will immediately make arrangements for the VEHICLE to the delivered to an APPROVED DEALER in order that the necessary repair work be carried out. In the event of the odometer being inoperative or defective AUTOSERV GLOBAL shall be entitled to calculate the estimated kilometres traveled by the VEHICLE during the period when the VEHICLE was operative and with reference to the state of the vehicle. AUTOSERV GLOBAL determination in this regard shall be final and AUTOSERV GLOBAL or an APPROVED DEALER, acting on behalf of AUTOSERV GLOBAL, shall be entitled to inspect and check the odometer reading and its operation at any time and during service intervals.

In event of the CLIENT wishing to store the VEHICLE for a period exceeding 3(three) months this will be done in compliance with the requirements as set out in the owner’s manual relevant to that vehicle
On signature of the service plan, and during the term/currency thereof to fully and truthfully provide AUTOSERV GLOBAL and any approved dealer, acting on behalf of AUTOSERV GLOBAL, with all information requested from the client in respect of the vehicle including information pertaining to the state, condition, service, maintenance and use of the vehicle as may be relevant and to ensure that such information is recorded in the service plan and To promptly carry out all the necessary maintenance on the vehicle through an approved dealer and to operate and use the vehicle strictly in accordance with the manufacturer’s directions as set forth in the owner’s manual.8.

Transfer ability

It is not possible to transfer the service plan between vehicles or owners unless the vehicle is written off within the first 4 years of having purchased the service plan and it must not be the policy holders fault. In the event of the client disposing of the vehicle or ceasing to be the owner of the vehicle, the client shall immediately notify AUTOSERV GLOBAL in writing of this fact and supply AUTOSERV GLOBAL with the name and address of the new owner.

The service plan shall be deemed to have terminated with immediate effect upon the cession, assignment or transfer thereof by the owner of the said vehicle.

Accidental or Other Damage or Theft

In the event of the vehicle being stolen, destroyed or damaged beyond repair, the client shall immediately notify AUTOSERV GLOBAL in writing of this fact and the service plan shall be deemed to have been cancelled upon date of such occurrence and shall be of no further force or effect.

Limitation of Liability

AUTOSERV GLOBAL shall not be liable to the client of any third party in respect of: – Any loss, liability, damage, whether direct or consequential or expense which the client or third party may suffer as a result of which may be attributable to any act or omission whether negligence or otherwise, of the approved dealer in respect of any services rendered, work carried out on the vehicle in terms of the service plan. The personal injury or death of any person or the loss of or damage to any property, however caused, arising out of any services rendered or any work carried out on the
vehicle in terms of this service plan and/or the use of the vehicle by the client or any other persons.

Any act or omission by AUTOSERV GLOBAL whether by reason of default or negligence of AUTOSERV GLOBAL, in the performance of its obligations and the exercising of its rights under the service plan The client hereby indemnifies AUTOSERV GLOBAL and its directors, agents, employees, and servants against any claim of whatever nature which may be made against them arising out of any of the a foregoing occurrences.

Cancellation and Termination

AUTOSERV GLOBAL shall in its sole discretion have the right to forthwith cancel / terminate the service plan and Motor Aid Mechanical Failure plan upon written notice of such cancellation to the client in the event of:-
• Written notice from the Client within seven business days from receipt of payment informing AUTOSERV GLOBAL of a notice of cancellation of the Service and/or Motor aid Mechanical Failure Plan to effect a cancellation refund, subject to a 7% [Seven percent] cancellation fee of initial invoiced amount.

Any tampering with the odometer by any person whatsoever or should it be found that the odometer has been disconnected or the client failing to provide the approved dealer with any relevant information required inter alias in terms of section ‘’Clients Obligations’’ above, or failure to record such information on the service plan; or the client failing to have the vehicle serviced in accordance with the provisions set out in terms of section ‘’Clients Obligations’’ above or The vehicle being used in competitive racing or rally events. The client providing any false or fraudulent information to AUTOSERV GLOBAL and or approve dealer The CLIENT being sequestrated, placed in liquidation, under judicial management or, in the event of the CLIENT being a business, ceasing to carry on business; or The CLIENT committing any act of insolvency or making any arrangement or
compromise with his creditors. If the CLIENT is in breach of any or the other above terms or conditions (all of which are deemed to be material and capable of being remedied) of the SERVICE PLAN and persists in such breach for 14(fourteen) days after receipt of written notice from AUTOSERV GLOBAL to remedy such breach, AUTOSERV GLOBAL may, in addition to and without limiting any other rights it may have in terms of the service plan or in law forthwith cancel the SERVICE PLAN upon written notice of such cancellation of the CLIENT.

It is expressly agreed and declared that AUTOSERV GLOBAL and any APPROVED DEALER, acting on behalf of AUTOSERV GLOBAL, will be released from all liability and obligations under the SERVICE PLAN if AUTOSERV GLOBAL cancels the SERVICE PLAN in terms of this clause Such cancellation shall be without prejudice to any other rights or remedies that AUTOSERV GLOBAL may be entitled to under the SERVICE PLAN or in law.

Force Majeure

If AUTOSERV GLOBAL is rendered unable, wholly or in part by force majeure to carry out any obligation. If AUTOSERV GLOBAL is rendered unable, wholly or in part by force majeure to carry out any obligation under the SERVICE PLAN, it shall give prompt notice to the CLIENT of such force majeure with reasonable full particulars thereof and insofar as is known, the probable extent to which it renders AUTOSERV GLOBAL unable to perform or be delayed in performing such obligation arising out of the terms and conditions of the SERVICE PLAN, and such obligations
of AUTOSERV GLOBAL giving notice shall be suspended insofar as it is effected by such force majeure during, but no longer than continuance thereof.

AUTOSERV GLOBAL shall use all possible diligence to remove such force majeure as quickly as possible. The requirement that any force majeure shall be remedied with all possible diligence shall not require that settlement of strike, lockouts or other labour difficulties by AUTOSERV GLOBAL on terms contrary to it reasonable requirements. The method employed to handle, remedy or resolve such difficulties resulting from force majeure, shall be entirely within the discretion of AUTOSERV GLOBAL. The term ‘’force majeure’’ shall mean an act of God, strike other than that of AUTOSERV GLOBAL own employees, lockout, act of public enemy, war declared or undeclared, blockage, revolution, riot, insurrection, civil commotion, lightening, fire, storm, flood, explosion, governmental acts or restrains, embargoes and otherwise which is not reasonably within the control of AUTOSERV GLOBAL and whether of a temporary or permanent nature. In the case of force majeure continuing for more than a period of 60(sixty) days, AUTOSERV GLOBAL has the right to cancel the SERVICE PLAN forthwith by written notice to the CLIENT in which event the above statement shall be enforced.

Notices of Domicilium

The parties choose as their respective DOMICILIUM citandi ET execudandi for all purposes under the SERVICE PLAN, the following addresses:
AUTOSERV GLOBAL: 16 Belgonia, Somerset West, Cape Town, 7130 The Client at the street address set out in the ENROLLMENT FORM. Any Notice
Given in terms of the SERVICE PLAN shall be in writing and shall If delivered by hand is deemed to have been duly received by the addressee on the date of delivery; If posted by prepaid registered post, to the postal address of the addressee as set out below, be deemed to have beenreceived by the addressee on the fourth day following the date of such posting; and; If transmitted by facsimile to the facsimile number of the addressee as set out below, are deemed to have been received by the addressee on the next business day (not being a Saturday, Sunday or Public Holiday) after dispatch. Notwithstanding anything to the contrary contained in the SERVICE PLAN, a written notice or communication actually received by one of the parties from another party including by way of facsimile transmission shall be deemed to be adequate delivery. Either party may be given written notice to the other duly given, change its aforesaid DOMICILIUM to another physical address, which may not be posted or poste resent
within the Republic of South Africa, which new address shall take effect from date of receipt thereof in terms of above.

Cession

AUTOSERV GLOBAL shall be entitled to cede, assign or transfer all or any of its rights and/or obligations in terms of the SERVICE PLAN to any financial institution or any person whatever and to its successors in title, and the CLIENT hereby consents to any such cession, assignment and/ or transfer.

General Provisions

The SERVICE PLAN constitutes the entire agreement between AUTOSERV GLOBAL and the CLIENT relating to the subject matter hereof
No amendment or consensual cancellation of the SERVICE PLAN or of any document issued or executed pursuant to or in terms of the SERVICE PLAN and no settlement of any disputes arising under the service plan and no extension of time, wavier of relaxation or suspension of any of the provisions or terms of the SERVICE PLAN, shall be binding unless recorded in writing and signed by both parties. AUTOSERV GLOBAL shall be entitled to cede, assign or transfer all or any of its rights and/or obligations in terms of the SERVICE PLAN to any financial institution or
any person whatever and to its successors in title, and the CLIENT hereby consents to any such cession, assignment and/ or transfer.

No party shall be bound by any express or implied term, representation, warranty, promise or the like not recorded in the SERVICE PLAN, whether it induced the contract and/or whether it was negligent or not.
• AUTOSERV GLOBAL and CLIENT agree that in the event of any provision of the SERVICE PLAN being invalid, void, voidable or unenforceable for any reason whatsoever, the invalid provision shall be severable from the remainder of the SERVICE PLAN and shall not in any way affect the remainder of the SERVICE PLAN, which shall in that event constitute the agreement between the parties.

Warranty by Authority of the Person Signing

The person signing the SERVICE PLAN on behalf of the CLIENT warrants and represents that he is so authorized, where the CLIENT is a created entity (corporate or non-incorporate) and not a natural person, and that all information contained herein is factually correct. If the CLIENT is a created entity (corporate or non-incorporate) proof of the signatory’s authority must be furnished to AUTOSERV GLOBAL by way of written
resolution authorizing the signatory to enter into and signing the SERVICE PLAN.

General Overview and Cover

The Service Plan ensures your vehicle is serviced for the life time of ownership. The service plan covers the motor vehicle for unlimited kilometres ‘’Lifetime service’’ refers to engine service only. We will be provided with a new service plan book on the purchase of the service plan NO vehicle inspection is required once you have purchased the service plan The ‘’engine service’’ will be carried out at service dealers only- according to the
make of the motor vehicle or a service dealer as appointed by AUTOSERV GLOBAL The registered owner of the vehicle will ensure that the vehicle is booked in for service at required intervals and it is the owner’s responsibility to inform AUTOSERV GLOBAL three working days in advance prior to the vehicle being booked in for a service, which includes details of the registered service dealer. Should the vehicle have passed a kilometre reading of 50% prior to the next service interval and upon acceptance of the service plan ,AUTOSERV GLOBAL will cover a pro rata payment for the balance of the outstanding kilometres only – and thereafter full cover applies for all subsequent services. Prior to commencement of the service, the owner must present to the service dealer the AUTOSERV GLOBAL registration card proof of identification.

The Following Renders the Service Plan Null and Void Which Includes Refunds

• The sale of your motor vehicle or transfer of ownership
• The Plan holder is deceased
• The vehicle being written off due to any accident
• Theft of motor vehicle
• Non-payment of monthly cash payments (Monthly payment option only)
• Fraudulent and any abuse of service plan cover and its contents
• Tampering of odometer
• Engine capacity being changed during service plan cover.
• Vehicle being declared non road worthy
• Engine and chassis numbers changed or replaced

Refuted Claims

• Defective parts used/supplied by service dealer
• Negligence or any damage to motor vehicle by service dealer
• Inefficiencies on the part of the service dealer.

CERAMICA COATING

If during its warranty period, your coating shows any defects in manufacture or workmanship you should contact the AUTOSERV GLOBAL Installer that installed the coatings for your vehicle.
The warranty provided is based on the duration stated by the AUTOSERV GLOBAL Installer that applied the coatings for your vehicle.

Warranty Conditions

Applications needs to be performed by our trained personnel or authorised AUTOSERV GLOBAL Coatings Installer on a surface that is acceptable to us, and is maintained in accordance with our recommendations following all installation practices & guidelines as specified by AUTOSERV GLOBAL Coatings or any updates thereof.
This warranty is provided by AUTOSERV GLOBAL Coatings Installer to the Purchaser and is against blistering, bubbling, cracking, delaminating, peeling or noticeable lose gloss or reflectivity during the course of warranty duration from date of application or service treatment.
AUTOSERV GLOBAL Coatings will not protect against paint chips, scratches or other mechanical damages.
This warranty does not apply to vehicles used for commercial purposes
If this product fails to perform, the AUTOSERV GLOBAL Coatings Installer must be informed within 14 days of occurrence. The warranty shall be limited to preparing and recoating the affected area to correct the condition. The correction shall be made as soon as is practical, at the facility at which the original application was provided, unless otherwise agreed by the customer and the AUTOSERV GLOBAL Coatings Installer.
Purchaser desiring warranty service on any product covered by this limited warranty must provide all information contained on the warranty form to the AUTOSERV GLOBAL Coatings Installer.
This warranty does not warrant that any surface applied with AUTOSERV GLOBAL Coatings will not break and in no event shall its liabilities extend to injury, loss or damage whatsoever caused other than set out herein.
No warranty of compliance with any rule, regulation or law is made in relation to AUTOSERV GLOBAL Coatings as such requirements vary for different countries.
This warranty is personal to the Purchaser & is not transferable or assignable.
This warranty is valid from the date of the invoice.
The Purchaser’s vehicle should be inspected every six months by a AUTOSERV GLOBAL Coatings Installer During this inspection, the car will be inspected and if the vehicle requires cleaning for the purposes of the inspection, costs of cleaning are to be borne by the Purchaser.
The Purchaser’s vehicle maintenance must be done according to the maintenance schedule of AUTOSERV GLOBAL Coatings below:

Washing

For best results wash with IGL Eco clean Wash or IGL Eco shine Enhancer on a bi-weekly basis to avoid excessive contamination build up.
Avoid washing in direct sunlight to minimize streaking and water spotting.
Wash from the top down leaving the dirtiest sections for last to avoid cross contamination. Use separate soap and sponge/mitt for wheels.

Drying

Always dry completely and never leave to “air” dry. Tap water contains minerals that may leave deposits creating water spots.
Use quality IGL Microfiber towels for best results and avoid aggressive wiping, allowing the material to absorb the water.

Spot Removal

Never use aggressive products to polish the coating or remove surface contamination.
Never use excessive force to remove spots.
Bird droppings, tar, sap, etc. should be removed as soon as possible to avoid temporary staining or hardening on the coating. Any staining left behind from the bird droppings will break down over a few days without affecting the coating.

Leather and Fabric Maintenance Program

For best results, clean all leather/vinyl surfaces bi-weekly with IGL Eco clean Interior and Eco shine Leather to avoid contaminant build up and replenish the natural oils.
